Agreement to Terms
By accessing or using AppBricks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity and these Terms apply to it. If you do not agree to these Terms, do not use the Service.
Description of Service
AppBricks is a SaaS platform that monitors, tracks, and analyzes how brands and products appear in AI-generated search responses across third-party AI engines including but not limited to ChatGPT, Claude, Perplexity, Gemini, and Microsoft Copilot. The Service provides visibility scoring, competitor tracking, ranking data, and content optimization recommendations.
We do not control, operate, or have any affiliation with the AI search engines we monitor. Results, rankings, and data returned by those engines may change at any time without notice.
Accounts and Registration
To use the Service, you must create an account. You agree to:
Provide accurate, complete, and current registration information.
Maintain the security of your account credentials.
Notify us immediately at support@appbricks.xyz of any unauthorized access.
Accept responsibility for all activity that occurs under your account.
You may not share your account with others or create accounts for the purpose of circumventing usage limits. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.
Subscriptions and Payment
4.1 Plans
The Service is offered on a subscription basis. Current plan pricing and features are available at appbricks.xyz/pricing. We reserve the right to change pricing with 30 days' advance notice.
4.2 Billing
Subscriptions are billed in advance on a monthly or annual cycle, depending on your selected plan. All fees are in USD unless otherwise stated.
4.3 Free Trials
If you sign up for a free trial, you will not be charged until the trial period ends. You may cancel at any time before the trial ends to avoid charges.
4.4 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for unused portions of a billing period, except where required by applicable law.
4.5 Taxes
You are responsible for any applicable taxes. We will collect taxes where required by law.
4.6 Failed Payments
If a payment fails, we will attempt to retry the charge. If payment cannot be collected, we may suspend access to the Service until the outstanding amount is resolved.
5. Acceptable Use
You agree not to use the Service to:
Violate any applicable law or regulation.
Scrape, reverse engineer, or attempt to extract the underlying algorithms or data sources of the Service.
Submit false, misleading, or fraudulent domain or competitor information.
Attempt to gain unauthorized access to the Service or its infrastructure.
Use the Service in any way that could damage, disable, or impair the platform or interfere with other users.
Resell or sublicense access to the Service without our express written permission.
Use the Service to monitor or track individuals in a manner that violates applicable privacy laws.
We reserve the right to investigate suspected violations and to suspend or terminate accounts found in breach of these policies.
6. Intellectual Property
6.1 Our IP
All rights in the Service — including the platform, dashboard, algorithms, visual design, trademarks, and documentation — are owned by AppBricks, Inc. or its licensors. Nothing in these Terms grants you ownership of any AppBricks intellectual property.
6.2 Your Data
You retain ownership of all domains, keywords, content, and data you submit to the Service ("Customer Data"). You grant AppBricks a limited, non-exclusive license to use Customer Data solely to provide and improve the Service.
6.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.
7. Third-Party Services
The Service integrates with and monitors third-party AI platforms. We do not control, endorse, or take responsibility for the content, availability, or accuracy of those platforms. AppBricks makes no guarantee that any specific AI engine will continue to be monitored, as availability depends on factors outside our control.
8. Data and Accuracy
AI search results are dynamic and can vary based on model version, prompt phrasing, geography, and time of query. AppBricks provides tracking and trend data to the best of our technical capability, but we do not guarantee the accuracy, completeness, or real-time precision of any ranking, visibility score, or recommendation provided by the Service. Data should be treated as directional intelligence, not as a definitive record.
9. Confidentiality
Each party agrees to keep the other's non-public, confidential information ("Confidential Information") strictly confidential and not to disclose it to third parties without prior written consent. This obligation does not apply to information that is or becomes publicly known through no breach of these Terms, or that is required to be disclosed by law.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPBRICKS DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPBRICKS' TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO APPBRICKS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
IN NO EVENT SHALL APPBRICKS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless AppBricks, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Customer Data, or your violation of these Terms.
13. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if we determine you have breached these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, 12, and 14 survive termination.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in New Castle County, Delaware. You waive the right to participate in class action lawsuits.
If you are a consumer in the EU or UK, mandatory consumer protection laws in your jurisdiction may apply in addition to these Terms.
15. Changes to Terms
We may update these Terms periodically. For material changes, we will notify you at least 14 days in advance via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AppBricks regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
Waiver. Failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger or acquisition.
